Transferable Limited Warranty on Workmanship

Issued by Fort Comfort Gutters LLC, doing business as Fort Comfort Gutters Idaho (“Fort Comfort Gutters Idaho,” “we,” “us,” “our”), a division of Fort Comfort Services. Idaho Contractor License #5371187. The warranty period runs from the date of substantial completion of your project.

Transferable Limited Warranty on Workmanship

Work performed by Fort Comfort Gutters Idaho is warranted against defects in workmanship for a period of two (2) years from the date of substantial completion. During this period, if the work fails to perform as specified for your project because of how it was installed, we will bring the workmanship up to our professional standards at no cost to you.

Gutters and downspouts. Covered workmanship defects include:

• gutter runs hung at an improper pitch, causing standing water that does not drain to an outlet;
• hangers that were improperly spaced, improperly fastened, or fastened into unsound material we installed, causing sagging or separation from the fascia;
• leaks at seams, miters, end caps, and outlets caused by improper sealing or assembly;
• gutter set at an improper position relative to the roof plane or drip edge, causing water to overshoot or run behind the gutter;
• downspouts, elbows, and extensions that were improperly secured, improperly connected, or routed contrary to the agreed scope;
• fasteners that were improperly set or that penetrate a finished surface because of improper fastening.

Gutter guards and leaf protection. Covered workmanship defects include guards that were improperly fitted, improperly secured, or installed in a way that lifts shingles, voids their attachment, or prevents water from entering the gutter as the product is designed to allow.

Soffit and fascia. Covered workmanship defects include board or wrap that was hung out of plane or out of square, improper fastening, unsealed or improperly flashed penetrations, gaps at joints and terminations, and vented soffit installed in a way that blocks designed intake airflow.

How defects are evaluated

Installed work is evaluated against the scope, material, profile, and specifications set out in your signed agreement and invoice, and against normal industry practice for the material installed.

A defect must be visible under normal lighting conditions from a normal viewing position on the ground, and a performance issue must be observable under normal rainfall or a controlled water test. Minor variation in the appearance of a long metal run, including light waviness in the face of aluminum gutter, soffit, and fascia wrap, is inherent to the material and to on-site forming and is not a workmanship defect.

Debris accumulation, clogging, and the reduced flow that results from them are maintenance conditions rather than workmanship defects, and are addressed through gutter cleaning service rather than under this warranty.

Gutter cleaning and maintenance visits

Gutter cleaning, downspout flushing, and similar maintenance visits are a service rather than installed work, and are not covered by the two-year workmanship warranty. If our crew damages a component of your system during a cleaning or maintenance visit, we will repair or replace that component at no cost to you. Report it to us within thirty (30) days of the visit.

Transfer

This warranty may be transferred one time to a subsequent owner of the property if the property is sold during the two-year period. To transfer it, the new owner must notify us in writing at info@fortcomfortservices.com within thirty (30) days of the sale. The warranty then continues for the remainder of the original two-year term only and does not restart.

Manufacturer product warranty (separate)

The gutter coil, downspout, hangers, guards, sealants, fasteners, soffit and fascia material, and any other products installed on your project carry the warranty provided by their manufacturer. Manufacturer warranties on these materials commonly run twenty (20) to forty (40) years, though terms vary by product and are not always in that range. Those manufacturer product warranties are separate from this workmanship warranty, are provided directly by the manufacturer according to their own terms, and cover defects in the product itself, such as a finish or coating failure caused by a manufacturing flaw. If you have a product issue, we will help you connect with the manufacturer to make a claim.

General limitations and exclusions

This warranty does not cover:

• Acts of God and severe weather, including hail, high wind, heavy snow load, ice and ice damming, freezing, flooding, wildfire, lightning, and falling trees or limbs, and any damage, deformation, or separation that results from them.
• Impact and physical damage to gutters, downspouts, guards, soffit, or fascia from any source, including ladders, equipment, vehicles, thrown or blown debris, snow and ice sliding off the roof, and pressure washing.
• Interference by, or damage caused by, other trade partners and contractors, including roofers, solar installers, painters, siding and window contractors, holiday lighting installers, and pest control, and any work performed on or adjacent to our installation after we completed it.
• Solar panel systems, snow guards, snow retention systems, heat cable, and holiday lighting attached to, mounted over, or run through our installation, whether installed before or after our work, and any damage or performance issue arising from them.
• Damage, abuse, negligence, alteration, or normal wear and tear caused by occupants, guests, tenants, pets, birds, rodents, or insects.
• Clogging, overflow, standing water, ice buildup, and staining that result from debris accumulation, missed maintenance, or a cleaning interval that does not match the debris load at the property.
• Ice damming and any water intrusion or damage arising from it, including its underlying causes such as attic insulation and ventilation, roof design, and heat loss, none of which we install or assess.
• Roof condition and roof leaks, flashing and drip edge that we did not install, and any water intrusion originating above or behind the gutter line.
• Conditions arising from framing, fascia, soffit, substrate, or existing components that we did not install, including rot, insect damage, or failed fasteners in fascia that you declined to have replaced.
• Performance of a system where you directed us to reuse existing gutters, downspouts, hangers, or drainage, or to match an existing size or profile that is undersized for the roof.
• Grading, soil, foundation, landscaping, and subsurface drainage conditions, and any water that reaches the structure after leaving the downspout or discharge point.
• Color, sheen, and finish variance between new material and surrounding weathered or previously painted surfaces, and normal fading, chalking, and oxidation over time.
• Repairs we performed where the underlying source of water or damage was not corrected before or after our work.
• The materials themselves, which are covered by the manufacturer product warranty described above rather than by this workmanship warranty.
• Any work for which payment has not been made in full under your signed agreement and invoice.

How to make a claim

Contact us within the warranty period at (208) 572-7129 or info@fortcomfortservices.com and describe the issue. Photos of the area, and of the condition during rainfall where relevant, help us respond faster. We may schedule an inspection to confirm the cause. If the issue is covered, we will correct the workmanship as described above and schedule the repair at a mutually agreeable time. Seasonal conditions, including ice and snow that make ladder work unsafe, may affect scheduling.

Limitations

This is a limited warranty. To the fullest extent permitted by law, our sole obligation is to correct covered workmanship, and we are not liable for any incidental, consequential, or other damages. This warranty does not affect the separate manufacturer product warranties, is part of and subject to your signed agreement and invoice terms with Fort Comfort Gutters Idaho, and is governed by the laws of the State of Idaho.
