These Terms and Conditions (“Terms”) govern your access to and use of the website at fortcomfortguttersidaho.com and any related pages, forms, and content (the “Site”), operated by Fort Comfort Gutters LLC, doing business as Fort Comfort Gutters Idaho (“Fort Comfort Gutters Idaho,” “we,” “us,” or “our”), a division of Fort Comfort Services. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Fort Comfort Gutters Idaho provides residential and commercial gutter services across Idaho’s Treasure Valley, including seamless gutter installation, gutter repair, gutter cleaning, gutter guards and leaf protection, soffit and fascia repair and replacement, and downspout and drainage work. We may update these Terms from time to time. When we do, we will change the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms. We encourage you to review this page periodically.
You may use the Site for your own personal, non-commercial purposes and to learn about and request our services. You agree not to:

All content on the Site, including text, graphics, logos, page layouts, photographs, and the selection and arrangement of that content, is owned by or licensed to Fort Comfort Gutters Idaho and is protected by copyright, trademark, and other laws. The “Fort Comfort Gutters,” “Fort Comfort Gutters Idaho,” and “Fort Comfort Services” names and logos are our trademarks. You may not use them without our prior written permission.
Product names, brand names, and logos of gutter coil, gutter guard, fastener, sealant, and building product manufacturers displayed on the Site are the property of their respective owners. They are used to identify materials we install. Their appearance on the Site does not imply that those owners endorse, sponsor, or are affiliated with Fort Comfort Gutters Idaho.
The content on the Site is provided for general informational purposes. Descriptions of materials, gutter sizes and profiles, guard types, timelines, pricing ranges, code compliance, and similar information are general in nature and may not reflect the specifics of your home or property. Nothing on the Site is a binding offer, a guarantee of price or availability, or a promise to perform any particular work.
Any per linear foot range or price shown on the Site is a general reference only. Actual pricing depends on your total footage, material, profile, roof height and pitch, access, and the final agreed scope of work.
When you submit a form or contact us to request an estimate or an inspection, you are asking us to follow up with you. You are not entering into a contract for services, and we are not obligated to provide services until a separate written agreement is signed by both you and Fort Comfort Gutters Idaho.
Any prices, recommendations, or estimates we discuss are subject to an in-person assessment of the actual property, and may change based on conditions found there, including roof pitch and height, safe ladder access, the condition of the existing fascia, soffit, hangers, and downspouts, drainage and grading, and damage that is not visible until the existing system is removed, as well as material availability and the final agreed scope of work. The terms of any actual project, including pricing, warranties, and scope, are governed by that separate signed agreement and by our invoice terms, and not by the Site or these Terms.
Gutters mount directly to the fascia board, and the fascia and soffit behind an existing gutter run often cannot be assessed until that run is removed. Where we discover rot, water damage, pest entry, failed fasteners, or other conditions that were not visible at the time of the estimate, we will stop, tell you what we found, and discuss the options before continuing. Scope, schedule, and price may change as a result.
Recommendations we make during a free inspection reflect what our crew can observe from the ground and from the roofline on the day of the visit. They are not a structural, roofing, or engineering assessment of your home.
We are a gutter, soffit, and fascia contractor. We are not roofers, and we are not an asbestos, lead, or mold abatement contractor. We do not perform testing or abatement, and we do not diagnose or repair roof leaks, attic insulation and ventilation deficiencies, foundation conditions, or the underlying causes of ice damming.
Painted exterior surfaces on homes built before 1978, including fascia boards and soffit, may contain lead-based paint. Where suspect material may be disturbed, testing or work by an appropriately certified party may be required before we begin, and abatement, if needed, must be completed before we start.
Where damage was caused by water, we repair or replace the gutter, downspout, soffit, or fascia components within our scope. We are not responsible for repeat damage where the underlying source of water has not been corrected, or for damage arising from the work of roofers, solar installers, painters, siding contractors, or other trades.
Our work requires safe ladder and roofline access. Unless your signed agreement says otherwise, you are responsible for providing that access and for moving or protecting vehicles, patio furniture, planters, and other personal property near the work area, securing pets, and unlocking gates before the crew arrives.
Gutter cleaning and gutter removal generate debris. We use reasonable protection and cleanup practices and haul debris away, but some residue, staining from years of accumulated material, and minor disturbance to landscaping directly beneath the roofline can occur and are normal.
We are not responsible for pre-existing conditions, for damage arising from fascia, framing, roofing, or substrate that we did not install, or for the performance of a system where you have directed us to reuse or match existing components.
By providing your phone number, email address, or other contact information through the Site or otherwise, you agree that Fort Comfort Gutters Idaho and those acting on our behalf may contact you about your inquiry and our services using the information you provided. This may include phone calls, emails, and text messages, including through automated or prerecorded technology where permitted by law. Marketing communications are also addressed in Section 11.
Consent to receive marketing calls or texts is not a condition of purchasing any product or service. Message and data rates may apply, and message frequency may vary. You can opt out of text messages at any time by replying STOP, and reply HELP for help. You can opt out of marketing emails using the unsubscribe link in those emails.
Calls to or from us may be monitored, recorded, or tracked for quality, training, and analytics purposes, including through third-party call-tracking and analytics services. By calling us or providing your number for us to call, you consent to this.
Fort Comfort Gutters Idaho is part of Fort Comfort Services, a family of home-services brands. By providing your information through the Site or in the course of doing business with us, you agree that we and our affiliated Fort Comfort Services brands may use the information you provide, along with information about how you interact with the Site and our advertising, to market products and services that may interest you. This may include contacting you by email, text message, phone, and mail, and sharing your information among Fort Comfort Gutters Idaho and other Fort Comfort Services brands and affiliates for these marketing purposes.
We also use cookies, pixels, device identifiers, and similar technologies, and we may share identifiers such as a hashed email address or phone number with advertising and analytics providers, including Google, in order to measure our advertising, build and reach audiences, and show you more relevant ads on other websites, apps, and platforms. This includes remarketing to people who have visited the Site and using customer-list audiences (for example, Google Customer Match). Depending on where you live, some of this activity may be considered targeted advertising, cross-context behavioral advertising, or a sale or sharing of personal data under applicable privacy laws.
Consent to receive marketing is not a condition of purchasing any product or service. You can opt out at any time: reply STOP to marketing texts, use the unsubscribe link in marketing emails, and use the choices described in our Privacy Policy to opt out of targeted advertising and the sharing of your information. We may offer or reference financing options provided by third-party lenders. Any financing is offered and administered by those third parties, is subject to their credit approval and terms, and is not guaranteed. We are not a lender, and we do not make credit decisions. Availability, rates, and terms are set by the third-party provider and may change.
Photographs and project examples on the Site are for general reference and may not depict the exact material, profile, color, or result available for your property. Actual results vary based on the home, existing conditions, and the agreed scope of work.
Materials we install carry warranties provided by their manufacturers. Those manufacturer warranties are separate from any workmanship warranty we provide, and their terms are set by the manufacturer. Details of any product warranty and any workmanship warranty applicable to your project will be provided in your project documents, your invoice terms, and our written workmanship warranty.
Unless you tell us otherwise in writing, you agree that we may photograph completed work at your property, excluding personal property and anything that identifies you or the address, and use those photographs in our portfolio, on the Site, and in marketing.
Any reviews, testimonials, or project examples shown on the Site reflect the experiences of specific customers and are not a guarantee that you will have the same experience. Results vary based on the home, existing conditions, and other factors.
The Site may link to third-party websites or resources that we do not control, and to the websites of affiliated Fort Comfort Services brands. We provide these links for convenience only. We are not responsible for the content, products, services, or privacy practices of any third-party site, and a link does not mean we endorse it. Your use of any third-party site is at your own risk and subject to that site’s terms. Affiliated brand sites operate under their own terms and privacy policies.
Your use of the Site is also subject to our Privacy Policy, available at fortcomfortguttersidaho.com/privacy, which explains how we collect, use, and share information, including for the marketing and advertising described in Section 11. The Privacy Policy also describes how to exercise your privacy choices and rights, including how to opt out of targeted advertising and the sale or sharing of personal data where those rights apply. By using the Site, you consent to the practices described in the Privacy Policy.
We want the Site to be usable by as many people as possible, and we work to improve the experience for users of assistive technologies. The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, or current. This section does not affect any warranty provided in a signed agreement, in our invoice terms, or in our written workmanship warranty for actual services.
To the fullest extent permitted by law, Fort Comfort Gutters Idaho and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your access to or use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Site will not exceed one hundred dollars ($100). This section does not limit liability for any actual services, which is addressed in the separate agreement and invoice terms for that work.
You agree to indemnify and hold harmless Fort Comfort Gutters Idaho and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site that is not resolved informally will be brought exclusively in the state or federal courts located in Canyon County, Idaho, and you consent to the personal jurisdiction of those courts.
Before filing any claim, you agree to first contact us and attempt to resolve the matter informally in good faith.
Assignment. We may assign or transfer these Terms and our rights and obligations under them, including in connection with a merger, acquisition, sale of assets, or by operation of law, without notice or your consent. You may not assign these Terms without our prior written consent.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
Electronic communications. When you use the Site or send communications to us, you consent to receive communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
Eligibility. The Site is intended for users who are at least 18 years old and is not directed to children. We do not knowingly collect personal information from children.
Promotions. Any promotions, discounts, or special offers we advertise are subject to their stated terms, may not be combined unless we say so, and may be changed or ended at any time.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, are the entire agreement between you and Fort Comfort Gutters Idaho regarding your use of the Site, and they supersede any prior agreements on that subject. These Terms do not govern any gutter, soffit, fascia, or drainage services, which are subject to your signed agreement, our invoice terms and conditions, and our written workmanship warranty.
